Who Is Covered Under FMCSA Drug Testing Requirements?

Employers and individuals who operate a commercial motor vehicle (CMV) with a gross vehicle weight of 26,0001 or more pounds; or is designed to transport 16 or more passengers including the driver; or is of any size and is used to transport of hazardous materials that require the vehicle to be placarded.

What Regulation Covers FMCSA Regulated Employers & Individuals?

49 CFR Part 382- Controlled Substances and Alcohol Use and Testing- This regulation outlines commercial trucks and bus drivers who are subject to DOT drug and alcohol testing under this regulation along with 49 CFR Part 40 requirements. This regulation authorizes the following types of testing for all “covered employees”

What is a Post Accident Test?

A DOT post accident drug and alcohol test is required and defined as follows. Post accident testing is required from any accident involving a fatality, in which one or more of the motor vehicles are towed from the scene or in which someone is medically treated away from the scene and a citation is issued to the CMV driver.
The following table listed below can be found in ยง382.303 (a) and (b). This may be used as a tool to use to determine when a post accident test would be required.

What is Reasonable Suspicion Testing?

This type of DOT required testing occurs when one trained supervisor or company official makes the decision which is based on specific, contemporaneous, articulable observations which concern the appearance, behavior, speech or body odors of the employee.

Employee Training

An FMCSA regulated employer must provide educational materials explaining the drug & alcohol regulatory requirements and an employer's policies and procedures. Employers should distribute these educational materials and the employer's policy regarding the use of drugs and alcohol is mandatory.

Supervisor Training

An FMCSA regulated employer must have at least one trained supervisor or company official that receives one hour of training regarding the specific, contemporaneous physical, behavioral and performance indicators of probable drug use and one hour of training is also required on the specific contemporaneous physical, behavioral and performance indicators or probable alcohol use.
